Family Awarded $6.7M in Car Seat Suit

Last week $6.7 million was awarded to the parents of a 4-month-old boy who passed away from head injuries during a 2000 car accident.

Deadly Car Crash

The Montana toddler was instantly killed when Ned Harris made a bad pass onto oncoming traffic, causing Jessica Malcom to swerve to avoid being hit by the pickup.

Jessica's son, Tyler, reportedly struck his head on his car seat's hard plastic shell when his car seat was ejected from the car in the rollover crash.

Car Seat Safety Questioned

The Malcom's claim the manufacturers of the car seat Tyler was in did not make their seats correctly and they believe Evenflo is to blame for the child's death.

"Evenflo knowingly and deliberately put profits over the safety of children when dealing with the design of this 'On My Way' seat," claims the Malcom's attorney, Evan Douthit.

Settlement Reached

The 12-member jury concluded that Evenflo should pay the Malcom's $5.5 million for grief and mental anguish.

For the economic losses for their son, they were awarded $1.18 million and for medical and funeral expenses, $16, 500.
