A 26-year-old woman was recently sentenced to five years in prison after she left the scene of an accident and lied to authorities about her involvement.
Costly Accident
Claude Kelly, 60, was heading south on his 2002 BMW motorcycle when he noticed a car traveling north cross into his lane.
"The vehicle seemed to match my movements," says Kelly, "I moved to the right, the car moved to the right."
Kimberly E.Garcia was charged for failing to stop at the scene of the accident.
Defendant Flees Scene
Witnesses were soon at Kelly's side to assist the injured man and provided officers with Garcia's car information.
According to reports, Garcia fled the scene of the accident and called her mother to help her replace her front tire, which was damaged in the collision.
Investigators and Garcia's mother were told by the woman that she had been involved in a single vehicle accident and denied her involvement with Kelly's injuries.
However, officers soon found that to be untrue, and Garcia finally pleaded guilty to being at the scene of the accident.
Question of Character
District Judge Dave Gamble told Garcia when she received her sentence that she didn't "have a clue about right and wrong."
"The concerns I have are her veracity, character, whether she should ever be allowed to be behind the wheel of a car again," says Gamble.
Garcia claimed, "It was an honest mistake. I do feel bad. It's not like I can move on with my life. I didn't mean to hurt anybody."
However, she blames part of the accident on another driver.
"Another car tried to pass me on the double-yellow line. It was his fault."
Kelly is looking for compensation for his medial bills and hoping to move forward with his new life now that Garcia has been sentenced.
