Head Injury Causes Lawsuit

After a school bus hit a utility pole and caused one little boy to suffer severe head injuries and injured several others, a Cincinnati attorney filed a lawsuit against the bus company and the driver.

Attorney Stan Chesley claims that spending $3,000 on seat belts may have prevented the boy from being injured and having to spend 86 days in the hospital.

Lawsuit Filed

Cody Shively, a 12-year-old student, was on his way home from school when the bus, driven by Angelynna Young, suddenly crashed and he was tossed around like a teddy bear.

Chesley filed the suit against Young, the bus manufacturer, Navistar International Transportation Corp. and the Grant County School system.

Bus Driver Found Using Drugs

Angelynna Young, the driver of the bus, pleaded guilty to assault, wanton endangerment and drug possession in relation to the bus crash that injured Shively.

Police officials claim they found her tired and under the influence of both prescription and illegal drugs.

Chesley included the school in the lawsuit for not having recognized complaints concerning Young sooner and for not properly supervising her.

Should Seat belts Be Required on Buses?

Although the bus company, which is the largest bus company in the nation with over 60 percent on the market, has lobbied to keep seat belts from becoming mandatory on their vehicles, Chesley hopes this will change their opinion.

A bus without seat belts is every bit as unsafe as a bus without tires or brakes, claims Chesley.
