The parents of a 15-year-old boy, who died in a car accident, have filed a suit against the driver of the car and the driver who hit the SUV the boy was a passenger in.
The suit, filed in Texas Township was the first of two filed by the mourning parents.
Richard and Shelly Phelps also filed a suit against Allstate Property and Casualty Insurance Co.
Two Suits Filed
The first suit has been filed against Bjorn Grubelich who was the driver of the Toyota 4Runner at the time of the accident.
This suit alleges that Grubelich, 17, overloaded the car and didn't ensure that all of his passengers were wearing seatbelts.
Bjorn's mother, Heidi, was also named in the suit as being liable for Phelps' injuries.
Alan Goodwin, the driver of the car that hit the 4Runner is also named in the suit as being responsible for Phelps' death since he was going 87 miles per hour.
In the suit against Allstate, the Phelps claim that the company covered the 4Runner since Goodwin had no liability insurance.
Driver Sent to Prison
Goodwin, 22, has been sentenced to 16 to 24 months in prison for negligent homicide in the killings of three boys killed in the accident, including Phelps.
Both suits are seeking damages for up to $25,000.
